The current energy conservation standards are located in title 10 of the Code of Federal Regulations (“CFR”) part 430, section 32 (a). The currently applicable DOE test procedures for consumer refrigerators, refrigerator-freezers, and freezers appear at 10 CFR part 430, subpart B, appendices A and B (“Appendix A” and “Appendix B”).
“Cooler” means a cabinet, used with one or more doors, that has a source of refrigeration capable of operating on single-phase, alternating current and is capable of maintaining compartment temperatures either no lower than 39 °F (3.9 °C) or in a range that extends no lower than 37 °F (2.8 °C) but at least as high as 60 °F (15.6 °C). Id.
DOE also requests data on the fraction of full-size consumer refrigerator and refrigerator-freezer sales in the residential sector that go through both a wholesaler/retailer and a contractor as well as the fraction of sales that go through any other identified channels.
Most recently, DOE completed a third rulemaking cycle to amend the standards for consumer refrigerators, refrigerator-freezers, and freezers by publishing a final rule in 2011 (“September 2011 Final Rule”). 76 FR 57516 (Sep. 15, 2011).
“Refrigerator technology keeps improving, and today the standards are catching up to ensure every new model uses key energy-saving features,” said Andrew deLaski, executive director of the Appliance Standards Awareness Project, a party to the joint recommendation.
